RestockPal terms of use

These terms are an agreement between you and MNS Industries LLC ("we", "us") for the RestockPal app and its web pages (the "Service"). By using the Service, you agree to them. If you don't agree, please don't use RestockPal.
1. Who can use RestockPal
You must be 18 or older and able to agree to these terms. You may have one account. Don't create accounts for other people, share your account, or create accounts to get around a suspension.
2. Sightings come from other parents
Reports, photos, and tips are posted by users. We don't check them in person, and stores don't provide them. Stock, prices, and purchase limits change quickly. RestockPal doesn't guarantee that any item is in stock or available at any price. Use your judgment, check how recent a report is, and call ahead before a long trip. We aren't responsible for trips, purchases, or decisions based on what users post.
3. Community rules
Report only what you saw yourself. You agree not to:
- Post fake, misleading, or made-up reports, including false "sold out" or "gone" reports meant to keep others away from a store.
- Harass, threaten, or embarrass anyone, or post hateful, sexual, violent, or otherwise objectionable content.
- Include people, faces, license plates, or personal information in photos or tips.
- Post ads, spam, resale offers, or links to sell items.
- Use bots, scripts, or scraping, or try to manipulate votes, points, badges, or alerts (for example, with multiple accounts).
- Interfere with the Service, try to access accounts or systems that aren't yours, or break the law.
We have zero tolerance for objectionable content and abusive users. You can flag any report from its ⋯ menu. We review flags, may remove content or limit features at any time, and may suspend or ban accounts that break these rules, usually within 24 hours of a valid report.
4. Your content
You own what you post. You give us a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your reports and photos to operate, improve, and promote RestockPal, and to use them in combined statistics such as restock patterns. This license ends when you delete the content, except for copies already shared by others, combined statistics, and backups that roll off on schedule. You're responsible for what you post and confirm you have the right to post it.
5. RestockPal Plus (subscriptions)
RestockPal Plus is an optional paid subscription. Before you buy, the app shows the price and billing period.
- Automatic renewal: Plus renews automatically at the end of each period (monthly or yearly) at the then-current price, and your Apple ID is charged within 24 hours before the period ends, until you cancel.
- How to cancel: iPhone Settings → your name → Subscriptions → RestockPal → Cancel Subscription. Cancel at least 24 hours before the renewal date to avoid the next charge. You keep Plus until the end of the period you paid for.
- Free trials and earned months: if a free trial is offered, it turns into a paid subscription unless you cancel before it ends; the app shows the trial length and price first. Free months earned with points don't renew into a paid plan.
- Billing and refunds: Apple handles all payments, and refunds are subject to Apple's policies (reportaproblem.apple.com).
- Price changes: we'll tell you before a price change applies to your subscription, and Apple will ask for your consent where required.
6. Store links and affiliate disclosure
Some links to retailers are affiliate links. If you buy something after tapping one, we may earn a commission at no extra cost to you. As an Amazon Associate, we earn from qualifying purchases. Retailer sites and apps are run by others and have their own terms and privacy policies.
7. Amazon AutoBuy (optional)
AutoBuy is an optional feature that runs on your own computer and can buy items on your own Amazon account within limits you set. You're responsible for every order it places, for your Amazon account, and for complying with Amazon's terms, which may restrict automated tools. Amazon can change its website at any time, which may cause AutoBuy to fail or behave unexpectedly. Start in practice mode, set price and order limits, and use it at your own risk.
8. Trademarks
NeeDoh is a trademark of Schylling, Inc. Store names and logos belong to their owners. RestockPal is independent and is not affiliated with, sponsored by, or endorsed by Schylling or any retailer.
9. Our rights
We may change, pause, or stop any part of the Service, and may suspend or end your access if you break these terms or to protect users. You can stop using RestockPal and delete your account at any time.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND WE DON'T WARRANT THAT USER CONTENT IS ACCURATE OR THAT THE SERVICE WILL BE UNINTERRUPTED.
11. Limit of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, WE WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, TRAVEL COSTS, OR PURCHASES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $50. Some states don't allow these limits, so they may not apply to you.
12. Indemnity
If you break these terms or the law, or post content that harms someone, you agree to cover the reasonable costs of claims against us that result, to the extent allowed by law.
13. Governing law
New Jersey law governs these terms, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in New Jersey, except that either of us may bring a claim in small-claims court where it qualifies. Nothing here limits rights you have under your state's consumer protection laws.
14. Apple App Store terms
If you downloaded RestockPal from the Apple App Store: these terms are between you and us, not Apple. Apple isn't responsible for the app or its content and has no obligation to provide maintenance or support. If the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); Apple has no other warranty obligation. Apple isn't responsible for any claims relating to the app, including product liability, legal or regulatory compliance, or consumer protection claims, or for any third-party claim that the app infringes intellectual property, which we'll handle. You confirm you're not in a country under a U.S. government embargo and aren't on a U.S. prohibited-parties list. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Apple's Licensed Application End User License Agreement also applies where it doesn't conflict with these terms.
15. Copyright complaints
If you believe content on RestockPal infringes your copyright, email nick@mnsindustriesllc.com with the content's location, your contact details, and a statement that you're the owner or authorized to act for them. We'll remove infringing content and may end repeat infringers' accounts.
16. Changes
We may update these terms. We'll change the date at the top and, for significant changes, tell you in the app before they take effect. Continuing to use RestockPal after that means you accept the updated terms.
